1. OVERVIEW
This website is operated by 2400101 Ontario Inc. (operating as Star5 Seat Covers). Throughout the site, the terms “we”, “us” and “our” refer to 2400101 Ontario Inc. and its associates. By visiting our site, purchasing our products, or using our installation services, you agree to be bound by the following terms and conditions (“Terms of Service”).
Trademark & License Notice: The trademark "STAR5 SEATCOVERS" and related designs are used under license by 2400101 Ontario Inc. All operations, sales, transactions, and services provided on this site are performed solely by 2400101 Ontario Inc. You acknowledge that your commercial relationship and contract for sale is exclusively with 2400101 Ontario Inc.
2. PRODUCT USE & SAFETY DISCLAIMER (IMPORTANT)
By purchasing our products, you acknowledge and agree to the following:
Aftermarket Nature:
Our products are aftermarket accessories and are not manufactured by, endorsed by, or affiliated with the original vehicle manufacturer (OEM).
Side-Impact Airbags:
While many of our seat covers are designed to be "airbag compatible,"
it is the sole responsibility of the customer
to ensure that the seat covers are installed correctly and do not obstruct the deployment of side-impact airbags.
Liability Release:
2400101 Ontario Inc.
shall not be held liable for any personal injury, death, or property damage resulting from the failure of a vehicle's safety system (including airbags) to deploy, or for improper deployment, in the event of an accident. You assume all risks associated with the modification of your vehicle's interior.
3. INSTALLATION SERVICES
If you choose to have your products installed at our North York location, the following terms apply:
Pre-Existing Damage:
We are not responsible for pre-existing damage to the vehicle. We recommend you inspect your vehicle with our technician prior to the start of service.
Brittle/Aged Parts:
In older vehicles, plastic clips, levers, and trims can become brittle. While we take extreme care, we are not liable for the breakage of minor plastic clips or fasteners that may occur during the normal course of installation due to age or material fatigue.
Personal Items:
Please remove all valuable personal items from the vehicle before installation. We are not responsible for lost or misplaced items left inside the vehicle.
Right to Refuse:
We reserve the right to refuse installation on vehicles that are excessively dirty or contain hazardous materials.
4. LIMITATION OF LIABILITY
To the fullest extent permitted by law, 2400101 Ontario Inc. (and our directors, officers, employees, agents, contractors, licensors, and suppliers) shall not be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service.
Cap on Damages: In no event shall our total liability to you for all damages, losses, and causes of action exceed the amount paid by you for the specific product or service at issue.
5. INDEMNIFICATION (LEGAL PROTECTION)
You agree to indemnify, defend and hold harmless 2400101 Ontario Inc. and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.
6. ERRORS, INACCURACIES, AND OMISSIONS
Occasionally there may be information on our site that contains typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times, and availability. We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).
7. INTELLECTUAL PROPERTY RIGHTS
All content included on this site, such as text, graphics, logos, images, digital downloads, and data compilations, is the property of 2400101 Ontario Inc. or its content suppliers (or used under license) and is protected by Canadian and international copyright laws. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service without express written permission by us.
8. WARRANTIES
Our products come with a 1-Year Limited Warranty as detailed on our [Warranty Policy page]. This warranty is in lieu of all other warranties, express or implied, including any implied warranties of merchantability or fitness for a particular purpose. This warranty does not cover damage caused by improper installation (if not installed by us), misuse, normal wear and tear, or exposure to harsh chemicals.
9. RETURNS AND REFUNDS
Our return policy is strictly limited to 30 days from receipt of the product (for online orders) and 15 days from purchase (for in-store purchases). Products must be in original, unused condition. Please review our full [Return Policy page] for details on restocking fees and eligibility.
10. GOVERNING LAW & JURISDICTION
These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein.
Dispute Resolution: Any legal action or proceeding relating to your access to, or use of, the site or products shall be instituted in a provincial or federal court in Toronto, Ontario. You agree to submit to the jurisdiction of, and agree that venue is proper in, these courts in any such legal action or proceeding.
